Terms of Use and Privacy Policy

1. General Conditions

By using this website and the ENOTOUR.PT application, you are subject to the terms described in these Terms of Use and Privacy Policy. We therefore recommend that you read them carefully to confirm that you agree with the terms described.

The ENOTOUR.PT project aims to promote the Vinho Verde and Alvarinho wines of Monção and Melgaço.

The ENOTOUR.PT platforms are managed by the Clube de Produtores de Monovarietais do Vinho Verde – VVCPM (Viticulturist Club), hereinafter referred to as VVCPM, Legal Person no. 514966084, with its registered office at Rua da Charneca, no. 2, 4960-010, Alvaredo, Portugal.

Use of the platforms, namely the website www.enotour.pt and the ENOTOUR.PT App, hereinafter referred to as the APP, implies acceptance of these Terms of Use and Privacy Policy, without any reservation.

The VVCPM reserves the right, at any time, to change the presentation and configuration of the website and APP, as well as to change these Terms of Use and Privacy Policy.

2. Property Rights

The contents of the website and APP, namely photographs, videos and other graphic elements are protected under the general terms of the law and by legislation on intellectual and industrial property, copyright and related rights, and may not be used outside these platforms without the prior written consent of VVCPM or the respective entities.

Usurpation, counterfeiting, exploitation of usurped or counterfeited content, illegitimate identification and unfair competition are criminal offences.

VVCPM reserves the right to take legal action against the authors of any copy, reproduction or other unauthorised use of the content of the platforms by third parties.

3. Privacy Policy

VVCPM determines the purposes and means of processing Personal Data as the controller of Personal Data, ensuring compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, and other applicable data protection and privacy legislation.

Garantimos que, neste último caso, a segurança dos Dados Pessoais é assegurada por obrigações contratuais, a fim de preservar a confidencialidade dos dados e conformidade com a lei em vigor. We guarantee that, in the latter case, the security of Personal Data is ensured by contractual obligations, in order to preserve the confidentiality of the data and compliance with the law in force. VVCPM is not obliged to appoint a Data Protection Officer (DPO) under the terms of the General Data Protection Regulation (GDPR), but we respect the Regulation and are available for any questions regarding your personal data.

In view of the above, the VVCPM undertakes to carry out any and all Personal Data processing operations in accordance with the provisions of the following points.

3.1.Consent

The DATA USER may give their consent to the processing of their data through a free, specific, informed and explicit expression of will, by means of a positive and unequivocal act.

a) Website

On the website, this manifestation is made by filling in the option shown on the application form at www.enotour.pt/pt/membros, and there is no collection of other Personal Data, namely Cookies. Consent can be withdrawn at any time by contacting info@enotour.com.

b) APP

In the APP, this manifestation is made by selecting the option shown when you start browsing.

3.2. Legitimacy, Processing and Purpose of Personal Data

The collection of Personal Data on the basis of these terms is essential for the fulfilment of the purposes for which the Personal Data is processed, namely within the scope of the management of the website, the management of relations with partner entities and the operation of the application.

The processing of Personal Data is carried out automatically and manually, using computerised tools, always respecting the purposes for which they are collected and, in any case, promoting the security and confidentiality of Personal Data.

a) Website

The Personal Data collected by the VVCPM on the website is intended, without reservation, for analysing and processing applications to the ENOTOUR.PT project, as well as for communications during the partnership period established between the VVCPM and the partner entity, in this case, DATA USER.

Since this Personal Data is necessary for the fulfilment of the VVCPM’s functions, its use is legitimate and the request for its removal implies the cancellation of the application, as the conditions for the establishment of the partnership between the VVCPM and the entity to which the data relates are no longer met.

Consent can be withdrawn at any time by contacting info@enotour.com.

b) APP

The Personal Data collected by the VVCPM in the APP is only intended to guarantee the execution of the functions of the application, namely access to the location of the device, strictly during the use of the application, and there is no collection and storage of any other type of Personal Data.

Since this Personal Data is necessary for the correct execution of the APP, its acceptance is required if the USER wishes to use it.

Consent can be withdrawn at any time by exiting and closing the APP.

3.3. Disclosure and Transmission of Personal Data

Personal Data may be processed by VVCPM employees for the performance of their labour duties and exclusively in accordance with the consent provided and under the terms specified in this Privacy Policy.

Personal Data may be made available to third parties entrusted with providing services for VVCPM, who are bound by a written contract obliging them to process the data under the terms required by the GDPR, and who may not process it, directly or indirectly, for any other purpose, for their own benefit or for the benefit of third parties, and who are required to guarantee technical and organisational measures to safeguard personal data during the existing relationship. Examples of subcontractors (third parties) are IT service providers and data hosting companies.

3.4. Personal Data Retention Period

VVCPM keeps Personal Data only for as long as it is relevant and useful for the purpose for which it was collected. The retention period for Personal Data is determined by the criteria described below and other applicable legislation. In the case of simultaneous application of criteria, we consider the longer period.

At the end of the retention period, the Personal Data will be deleted and/or the necessary security measures applied:

a) Data collected as part of applications to the ENOTOUR.PT project
(Name, email, telephone, mobile phone and address of the Contact Person) – 5 years

b) Data collected as part of requests for information – 1 year

c) Data required to fulfil legal obligations, as well as to exercise or enforce our rights, including recourse to courts and administrative bodies – 6 months after the resolution of each situation.

d) Localisation – for as long as you use the APP (no data storage)

3.5. User’s legal rights

The General Data Protection Regulation (GDPR) guarantees the protection and clarification of the rights of European Union citizens with regard to the privacy of their data. VVCPM guarantees USERS the enjoyment of their rights with regard to the privacy of their data, as stipulated by the General Data Protection Regulation (GDPR). The rights can be consulted at https://www.cnpd.pt/cidadaos/direitos/.

All DATA USERS have the right to access, rectify, cancel and object to their data.

3.6. Legal obligations

In fulfilment of legal obligations, the DATA USER’s Personal Data may be transmitted to third parties for their own purposes, namely judicial, administrative, supervisory or regulatory authorities, as well as entities that lawfully carry out data compilation actions and actions to prevent and combat fraud.

The VVCPM has adopted various security measures aimed at guaranteeing the defence of privacy and security issues related to the collection, processing and storage of Personal Data.

The Personal Data collected for processing is processed via a secure HTTPS (Hypertext Transfer Protocol Secure) connection that encrypts it and confers authenticity to the server where all the data on the www.enotour.pt website is hosted.

However, we would like to make USERS aware of the need to adopt additional security measures while browsing the Internet, namely using a computer and browser that are up-to-date in terms of properly configured security patches, with an active firewall, antivirus and antispyware.

VVCPM endeavours to continuously improve the security measures adopted, guaranteeing the processing of Personal Data with the level of protection legally required, taking into account the resources available and the state of the current technology made available.

4. Changes to the Terms of Use and Privacy Policy

VVCPM reserves the right to change these Terms of Use and Privacy Policy. All changes will be published on this page.

This privacy policy came into force on 01/01/2023, in accordance with the GDPR and LPDP and other applicable legislation.
